PRIVACY NOTICE PURSUANT TO ARTICLE 13 OF REGULATION (EU) 2016/679

This document describes the purposes and methods by which we will manage your personal data. In addition, you will find the necessary contact details should you have any questions regarding your data.

This privacy notice is drafted in accordance with various legal systems, including Articles 13 and 14 of Regulation (EU) 2016/679 (“GDPR”).

Please note that this Privacy Notice applies to any type of information collected by our Company through this website, via emails sent to us, through the customer call center, through other online platforms such as social media, or when you contact the reception of our facility.

Occasionally, we may need to amend this Privacy Notice, as well as our Cookie Policy. In case of significant changes, we will highlight them on our website and/or inform you through other means of contact, such as email, so that you may review such changes before continuing to use our services.
In any case, if you wish to remain constantly updated, we recommend that you periodically visit this page, as well as the cookie policy page.

What kind of personal data do we collect?

In order to organize your stay at our facility or to respond to your requests for information, we need to collect certain personal data such as: your first and last name, date of birth, details of your identity card or other identification document, contact information, the names, dates and places of birth, and where applicable, the identification documents of those traveling with you, payment details, any special requirements, the health booklet and insurance details of your dog traveling with you, etc.

Such information may be collected when you request a quotation or make a booking for your holiday, or when you contact our reception, either directly or through tools such as social media or our website.

Camping Cave is required to electronically transmit the personal details of its guests to the Brescia Police Headquarters for legal compliance purposes, and to forward data to the competent authorities for statistical purposes.

If you choose to pay for your stay by credit card, our Company will use the related data exclusively to charge the costs of your stay, in accordance with the general terms of service available on our website, and will not store or otherwise record such data on other media.

If you wish to access our facility with one or more vehicles, even temporarily, at the beginning of your stay you will be asked to provide your license plate number. This procedure allows access only to authorized vehicles, in order to ensure greater security for you and your fellow travelers.

Finally, please note that during your stay, moments of life within the camping facility may be recorded and used by our Company to promote our facility across different media. It is possible that in such images or videos, you and/or members of your party may be partially or fully visible.
By accepting the general terms of service at the time of booking, you have expressed your consent to the use of such images/videos for the aforementioned purposes.

We may also receive information about you from third parties such as tour operators or other business partners you engaged to organize your holiday.

Your data may be processed in both digital and paper formats.

When you interact with our business partners, you provide them with details of your requests/bookings, which are then forwarded to us.

We also rely on external providers to manage payments: these service providers share payment information with us to help us process payments and manage your booking, in order to provide you with the best possible experience.

Our business partners may also share information about you with us (and vice versa), for example in the event of questions about an ongoing booking, disputes, or other communications regarding your reservation.

If your booking includes other persons, or if you book on behalf of a third party, you will be asked to provide their details as well (e.g. name, surname, date of birth, ID card or other ID document details, contacts, etc.). In such cases, you must ensure that these persons have read this Privacy Notice in advance.

Whenever you provide us with the personal data of third parties, you must have their prior consent. In particular, if you provide data relating to minors, you must have the consent of the person(s) holding parental responsibility. Our Company may request proof of such consent at any time; failure to provide it may make it impossible for us to fulfill your booking request.

When browsing our website, we may collect certain data such as your IP address, browser identifier, URI (Uniform Resource Identifier) addresses of requested resources, the time of the request, the method used to submit the request to the server, the numerical status code of the server’s response, and other parameters related to your IT environment.

Such data is used only to verify the correct functioning of the website and, if applicable, to derive anonymous statistical information regarding its use.


Why do we collect and process your data?

We collect your data to manage your bookings, to provide you with the best service possible, and, if you have given your consent, to contact you and inform you about discounts and special offers reserved for you.

  • Quotation requests and/or bookings: your personal data are used to respond to your quotation requests and/or to complete and manage your booking.
  • Customer care and communications: we may contact you via email, phone, SMS, or WhatsApp. Your data may also be used to respond to your support requests.
  • Marketing activities: we may use your information for marketing activities regarding vacation packages, offers, and promotions from our facility, by sending newsletters or other communications, in some cases based on your expressed preferences, in order to reflect your interests. Please note that it may take a few days for our systems to update, so you may continue to receive communications while your request is being processed.
  • Reviews: during and/or after your stay, you may be invited to leave a review (even anonymously). By completing a review, you agree that it may be published, for example, on our website or on our social media pages, to inform other potential customers about the quality of our facility and services.
  • Legal purposes: in some cases, we may need to use your information to comply with legal obligations, to manage and resolve disputes, to cooperate with public authorities’ investigations, for compliance checks, or to enforce our terms of service.

In accordance with Article 6 of Regulation (EU) 2016/679, your data may be collected, processed, and stored on the following bases:

  1. For the performance of a contract, i.e. your booking, or to respond to requests for quotations or information, and to comply with legal obligations, also with respect to data of third parties you may provide;

  2. Based on your consent, for marketing purposes, unless you revoke such consent at any time;

  3. To pursue our legitimate interests.

For quotation requests/bookings, legal purposes, customer care, and communications with you, your consent is not required, as the processing is based on the grounds under point 1). Providing your data is not mandatory, but failure to do so may prevent us from providing the requested service.

Processing for marketing purposes, however, always requires your consent. Providing data for such purposes is not mandatory.


Disclosure of your data to third parties

We do not sell or transfer your personal data (including your name, residential address, email address, and credit card details) to third parties, and we will never do so. We believe that earning and maintaining your trust is absolutely fundamental.

However, in order to best manage your booking and your stay, we may need to share certain data with third parties involved in the provision of our services, such as banks, competent authorities, etc.

For example, if you or the cardholder request a chargeback, we may need to share booking-related information with the payment service provider and the relevant financial institution.

We may also share personal data with law enforcement when required by law, or when strictly necessary to detect, prevent, or conduct legal proceedings related to fraud or criminal activity.

Furthermore, we may share personal data with authorities to protect and defend our rights or property, or those of our business partners.

When you book through a tour operator or another business partner, certain data you provide will be shared with us. Similarly, we may share some of your data with such partners, for example in the event of disputes or booking changes.

If you book through a business partner (or their website/application), we invite you to carefully read their privacy policies, as we have no control over how they manage your personal data.

Additionally, your data may be accessible to external professional service providers such as IT consultants for system maintenance/upgrades; in such cases, we will ensure that they are bound by confidentiality obligations and handle the data appropriately.

We may also provide aggregated, anonymized data and analytics to third parties, ensuring that such data cannot be linked back to any specific customer.


Your information and non-EU countries

Our Company is based in Italy.

However, we may use IT systems (e.g. email providers, data storage systems) whose servers may be located outside the European Union. In such cases, our Company undertakes to ensure compliance with the provisions of EU Regulation 2016/679 regarding the protection of personal data.

In particular, in the event of data transfer outside the EU, we will ensure that the transfer is carried out in accordance with the Regulation and this Privacy Notice, and that it is governed by standard contractual clauses guaranteeing adequate protection for you and your data.


How we protect your data

It is in our best interest to ensure the security of your data in compliance with applicable data protection laws.

To this end, we have implemented a number of internal procedures and use specific IT security systems.

We have also implemented physical and technical safeguards to prevent unauthorized access to and use of personal data stored on our servers/archives.

In addition, we use an authorization system that allows only authorized personnel to access the data necessary to perform their tasks, and we ensure that any third parties with whom we may share your data are bound to confidentiality and use it exclusively for the purposes described in this Privacy Notice.


How long do we keep your data?

With your explicit consent, the personal details you provide at registration may be stored by Camping Cave in order to facilitate future check-ins for subsequent bookings/stays.

In this case, data will be stored for a maximum period of 5 years from the last stay, or until consent is withdrawn, whichever is earlier.

After this period, the data will be deleted or irreversibly anonymized.

Data processed for contractual, fiscal, or public security purposes will be stored for the periods required by law (e.g. 10 years for accounting and tax obligations).

Please note that user-generated content (e.g. comments and reviews) will be anonymized but may remain available on our website and/or social media.


Your rights regarding your data

You have many rights regarding your personal data.

You always have the right to request access to the personal data we hold about you.
You may also request its rectification in case of errors/changes, or its deletion.
You may also request that we restrict or object to the processing of your data.

However, please note that if data processing is required by law or necessary to conclude a contract (e.g. booking at our facility), requesting deletion or objecting to processing may prevent us from fulfilling your booking or providing the requested services.

Please note that withdrawal of consent does not affect the lawfulness of processing carried out prior to withdrawal.

You also have the right to request the transfer of your data, in whole or in part, to yourself or another service provider, and the right to lodge a complaint under Article 13 of Regulation (EU) 679/2016 with the supervisory authority.

Data Subject Rights

Users may exercise the rights guaranteed to them under Articles 15 and following of the Regulation, in the manner provided by Article 12, by contacting the Data Controller through the following means:

  • Sending a registered letter to the Controller’s registered office.

  • Sending an email to: cave@campingcave.it.

If you believe that the processing of your personal data violates the Regulation, you have the right to lodge a complaint with a Supervisory Authority (in the Member State where you habitually reside, where you work, or where the alleged violation occurred).
